Private Fitsimmons was wounded in the hip at the Battle of Antietam on September 17th, 1862 and again in the right leg at the Battle of Petersburg Virginia on June 18th, 1864. His leg was amputated at the knee and he died from the gangrene that set in.

His mother Rebecca was forced to file for a "Mothers" pension in July of 1865.
